Le consentement matrimonial est l\u2019acte de la volont\u00e9 par lequel un<br \/>\nhomme et une femme se donnent et se re\u00e7oivent mutuellement par une alliance irr\u00e9vocable<br \/>\npour constituer le mariage [c. 1057, \u00a7 2]. Peuvent contracter mariage tous ceux qui n\u2019en sont<br \/>\npas emp\u00each\u00e9s par le droit [c. 1058]. Les propri\u00e9t\u00e9s essentielles du mariage sont l\u2019unit\u00e9 et<br \/>\nl\u2019indissolubilit\u00e9 qui, dans le mariage chr\u00e9tien, en raison du sacrement, acqui\u00e8rent une solidit\u00e9<br \/>\nparticuli\u00e8re [c. 1056].<\/div>\n<div><\/div>\n<div class=\"moduleBody\">Du point de vue juridique, le consentement est un sujet tr\u00e8s vaste. Nous tenterons ici d\u2019en<br \/>\nexpliquer quelques importantes caract\u00e9ristiques. Le consentement est un acte humain qui ne<br \/>\npeut provenir que de la volont\u00e9 et il est impossible d\u2019y substituer de quelque fa\u00e7on. Rien ne<br \/>\npeut le remplacer. Il appartient \u00e0 la personne seule. \u00ab L\u2019objet \u00bb du consentement est le don de<br \/>\nsoi de l\u2019\u00e9poux, de l\u2019\u00e9pouse, l\u2019un envers l\u2019autre, dans le but de former et de vivre une alliance<br \/>\nd\u2019amour fid\u00e8le et f\u00e9cond. La t\u00e2che propre de la volont\u00e9 est d\u2019obtenir cet acte de consentement<br \/>\nlibrement exprim\u00e9; il ne peut s\u2019agir que d\u2019une seule pens\u00e9e dans la t\u00eate de la personne. Le<br \/>\nconsentement doit se manifester ext\u00e9rieurement. Il s\u2019agit d\u2019un consentement \u2013 pas deux \u2013 nous<br \/>\nrappelant l\u2019unit\u00e9 de l\u2019alliance, bien que deux personnes, un homme et une femme vont<br \/>\ns\u2019\u00e9changer mutuellement cet acte consensuel. Les deux parties doivent en avoir la capacit\u00e9<br \/>\njuridique, sans obstacles.<\/div>\n<div><\/div>\n<div class=\"moduleBody\">L\u2019alliance matrimoniale entre baptis\u00e9s a \u00e9t\u00e9 \u00e9lev\u00e9e par le Christ Seigneur \u00e0 la dignit\u00e9 de<br \/>\nsacrement. Par le mariage, un homme et une femme constituent entre eux une communaut\u00e9 de<br \/>\ntoute la vie, un partenariat de la vie enti\u00e8re, intimement li\u00e9 \u00e0 leur union conjugale particuli\u00e8re.<br \/>\nLe mariage est ordonn\u00e9 \u00e0 des fins sp\u00e9cifiques: le bien des \u00e9poux et la procr\u00e9ation et l\u2019\u00e9ducation<br \/>\ndes enfants. L\u2019unit\u00e9 et l\u2019indissolubilit\u00e9 sont des propri\u00e9t\u00e9s essentielles du mariage. Unit\u00e9 veut<br \/>\ndire fid\u00e9lit\u00e9; par cons\u00e9quent, logiquement parlant, si un couple rejette l\u2019unit\u00e9 ou<br \/>\nl\u2019indissolubilit\u00e9, ou tout autre \u00e9l\u00e9ment de ce qu\u2019implique leur consentement, c\u2019est qu\u2019ils ne<br \/>\nvoulaient pas vraiment faire mariage.
