Pour qu\u2019il y ait un mariage<br \/>\nvalide entre deux personnes, l\u2019homme et la femme doivent \u00eatre en mesure d\u2019exprimer leur<br \/>\nconsentement mutuel librement et irr\u00e9vocablement, et ne pas en \u00eatre emp\u00each\u00e9s par le droit<br \/>\neccl\u00e9sial. Toutefois, il peut arriver dans certains cas, malgr\u00e9 les apparences, qu\u2019un \u00e9l\u00e9ment<br \/>\nessentiel au consentement conjugal fasse d\u00e9faut. Une personne qui veut faire v\u00e9rifier s\u2019il y<br \/>\na eu un d\u00e9faut ou un emp\u00eachement quelconque doit en faire la demande au tribunal matrimonial<br \/>\nde son dioc\u00e8se. Le tribunal matrimonial rel\u00e8ve du minist\u00e8re de la justice dans l\u2019\u00c9glise.<br \/>\nIl est compos\u00e9 d\u2019une \u00e9quipe de professionnels qui connait bien le Droit canon.<\/div>\n<div><\/div>\n<div class=\"moduleBody\">Le consentement matrimonial est un acte l\u00e9gal \u00e0 caract\u00e8re public dont la validit\u00e9 peut \u00eatre<br \/>\nv\u00e9rifi\u00e9e de mani\u00e8re objective par un Tribunal matrimonial dioc\u00e9sain d\u00fbment constitu\u00e9. S\u2019il y a<br \/>\nd\u00e9faut, le r\u00e9sultat de cette d\u00e9marche judiciaire se terminera par une \u00ab d\u00e9claration de nullit\u00e9 de<br \/>\nmariage \u00bb ou comme on l\u2019appelle commun\u00e9ment une \u00ab annulation de mariage \u00bb. La d\u00e9marche<br \/>\nde nullit\u00e9 peut \u00eatre institu\u00e9e \u00e0 la demande de toute personne qui a \u00e9t\u00e9 mari\u00e9e, apr\u00e8s qu\u2019elle ait<br \/>\nobtenu au pr\u00e9alable un divorce au civil. Le processus comprend les \u00e9tapes suivantes :<br \/>\nle demandeur doit remplir un formulaire ; un libelle est pr\u00e9par\u00e9 fond\u00e9 sur les renseignements<br \/>\nfournis par la partie requ\u00e9rante ; une fois que le libelle a \u00e9t\u00e9 admis, le Tribunal d\u00e9signe un juge<br \/>\nqui demandera au requ\u00e9rant et au r\u00e9pondant de venir t\u00e9moigner en leur faveur sous serment,<br \/>\nainsi que de lui fournir les noms de t\u00e9moins capables de confirmer certains faits dont il a \u00e9t\u00e9<br \/>\nquestion. Les preuves sont amass\u00e9es aupr\u00e8s des t\u00e9moins par un auditeur nomm\u00e9 par le Vicaire<br \/>\njudiciaire. Rappelons-nous que le r\u00f4le du Tribunal matrimonial est de d\u00e9terminer ce qui<br \/>\nest valide et ce qui est invalide et rien d\u2019autre, ainsi que de rendre justice.
